Is it permissible to kill a snake or a scorpion during prayer without first warning it?

Machine translationRead the Arabic original
Question:
The fact that he (peace and blessings be upon him) ordered the killing of the two black ones: the snake and the scorpion, during prayer, whether it is one of the house snakes that is not the two-striped one or the tailless one: is it without warning, or is it specific to one that has been warned?

Answer:
It is possible that this abrogates the hadith of Abu Sa'id, the Prophet's (peace and blessings be upon him) general statement regarding these five and what came in their meaning. It is possible that it abrogates what came regarding the issue of the jinn of the houses, that they are killed absolutely, and that that is abrogated.
It is also possible that it is a clear, decisive text, and that his (peace and blessings be upon him) intent is snakes that are not the jinn of the houses, such as those found in mosques, on roads, or in the wilderness; these are killed. As for the snake in the dwelling, it is warned three times, and if it returns, it is killed, as came in the hadith:
Indeed, these houses have jinn from the jinnإنَّ لهذه البيوت جنانًا من الجنِّ
, and it may appear in the form of a snake, so it is not killed until it is warned three times.
Q: Three times, even if in one day?
A: Even if in one day. If it is warned three times, in some narrations it is three times, in some it is three days, and in some it is three times. The result is that the warning is three times, whether in one day or in days.
Q: Is the closer view that this is a specification, and that this is specific from the generality of the hadith? That the jinn of the houses are excluded?
A: The closer view according to the rule is: the specific overrides the general. This is a rule.
