Question:
It is widespread among many people—the question is still from our sister Umm Abdullah—it is widespread among many people to say: “I swear by the signs of Allah.” I ask your eminence to clarify the punishment for this matter, thank you. Also, it is widespread for them to say when swearing: “By the mercy of my parents,” or “By the head of so-and-so.” I ask you to clarify this strongly at this point. May Allah reward you with good.

Answer:
As for swearing by the signs of Allah, there is no blame on him if the one swearing means the Qur’an when he says: “I swear by the signs of Allah”; there is no blame; because the Qur’an is the speech of Allah, just as if he said: “I swear by the knowledge of Allah, by the majesty of Allah”; there is no blame in that.
But if he means the created signs, such as the night and the day, the sky and the earth, this is not permissible. Likewise, “the mercy of your parents” is a general term; it is not fitting to swear by the mercy of your parents, or by trustworthiness, or by the head of so-and-so, or by the honor of so-and-so; all of this is not permissible. As for “your parents,” who shows mercy to you is you, toward your parents, or is it his mercy, or is it the mercy of Allah? If the intended meaning is the mercy of Allah, that Allah shows mercy to your parents, then this has the ruling of the attributes. If he intends the mercy of Allah for his parents, this is one of the attributes of Allah. But if he says: “... his mercy,” if Allah shows mercy to his parents, if you show mercy to your parents and give me such and such, you show him mercy, then the mercy of the created being toward his parents is a created mercy, and one does not swear by it.
The conclusion is that the oath is made by Allah, or by one of His attributes, not by the attributes of creation, nor by their lives, nor by so-and-so's head, nor by so-and-so's honor, and so on. This is not permissible; the oath is made by Allah alone or by one of His attributes Yes.
