Question:
After this, we move on to a message received by the program from listener Ibrahim Adam from Sudan. Our brother has more than one issue in his questions. In the first issue, he asks and says: A relative of mine passed away and bequeathed that a mosque be built adjacent to his grave. Should his bequest be carried out, or not?

Answer:
It is not permissible to carry it out. Mosques are not to be built on graves, nor next to graves, nor between graves. The Prophet (peace and blessings be upon him) said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى؛ اتخذوا قبور أنبيائهم مساجد
Sahih Muslim 529
Aisha said: “Beware of what they did.”
The point is that mosques should be in suitable locations for the people of the town, away from graves. As for the grave, nothing is to be built on it, and no mosques are to be built between graves. All of this is wrong. All of this is among the causes of shirk (associating partners with Allah)—we seek refuge in Allah—among the means of shirk. Therefore, it is not permissible. In fact, this is among the practices of the Jews and the Christians. We ask Allah for safety from it.
Therefore, this bequest is invalid and is not to be carried out.
