Question:
The listener Mahmoud sent a message saying: There is a group who claim to be the descendants of the Messenger of Allah (peace and blessings be upon him), and some people pledge allegiance to them as the Prophet (peace and blessings be upon him) used to pledge allegiance. The question is: Does the Prophet (may the best prayers and peace be upon him) have descendants, and is it permissible to pledge allegiance to them on this basis? It is known that they have made their father’s grave a shrine and live next to it. We ask for clarification and an explanation of the ruling of the religion regarding this claim, and may you have reward and recompense from Allah (Glorified and Exalted is He)?

Answer:
Yes, he (peace and blessings be upon him) has descendants through his daughters. As for his male children, they died young and have no descendants. His descendants are only through his daughters, through al-Hasan and al-Husayn, the sons of Fatimah (may Allah be pleased with them all). Al-Hasan and al-Husayn have descendants. If their lineage is preserved and established by evidence, they are considered from the Banu Hashim, and charity and zakah are not permissible for them, due to the saying of the Prophet (peace and blessings be upon him):
It does not become the family of Muhammad (to accept) sadaqat for they are the impurities of peopleإنها لا تنبغي لآل محمد، إنما هي أوساخ الناس
Sahih Muslim 1072a

So charity is not permissible for the Household of Muhammad if they are from the descendants of al-Hasan, or al-Husayn, or anyone else who claims descent from Banu Hashim, such as the children of Ali, absolutely, like the children of Muhammad ibn Ali and others.
So the conclusion is that whoever is from the descendants of Banu Hashim is from his Household (peace and blessings be upon him). And whoever is from the descendants of al-Hasan and al-Husayn is considered from his descendants (peace and blessings be upon him) through his daughters. As he said about al-Hasan:
Indeed, this son of mine is a chiefإن ابني هذا سيد
Jami` at-Tirmidhi 3773Sahih (Darussalam)
, calling him his son, although he is the son of his daughter.
So the children of daughters are descendants. Allah named Isa (Jesus) from the descendants of Adam, although he is from the descendants of Maryam, the daughter of Maryam, and he has no father (peace and blessings be upon him). And Allah included him in the descendants, the descendants of Adam and the descendants of Ibrahim.
So the conclusion is that the children of daughters are from the descendants of their grandfather, who is the father of their mother. So if it is known by Sharia evidence that he is from Banu Hashim, whether he is from the children of al-Hasan, or al-Husayn, or others, he is considered from the People of the House, and it is not permissible for them to take from zakah by the explicit text of the Prophet (peace and blessings be upon him).
As for the pledge of allegiance, it has no basis. They do not pledge allegiance except to one who has seized control of the Muslims, and the Muslims have approved of him and pledged allegiance to him. This is fine, like how Ali (may Allah be pleased with him) was pledged allegiance to when he took charge of the Muslims after Uthman (may Allah be pleased with him).
So the pledge of allegiance is only for the one in authority, either by force and dominance if he takes control of the Muslims and subdues them with his sword, they pledge allegiance to him, as the Muslims pledged allegiance to Abd al-Malik ibn Marwan, and pledged allegiance to others, or by the agreement of the people of authority and decision to pledge allegiance to a person who takes charge of them, because he is qualified for it. As for pledging allegiance to the best of people, this has no basis. Or pledging allegiance to the heads of associations, this has no basis. So the pledge of allegiance is only from the side of the people of authority and decision in lands where there is a state, where there is no ruler, where there is no emir. The people of authority and decision gather to pledge allegiance to a person qualified for it, because their ruler, or the president of their republic, has died, so they agree to pledge allegiance to a person in place of the deceased, or they pledge allegiance to a person who has seized control of them by force and dominance until he becomes their emir by force and dominance, then he is pledged allegiance to at that time.
