The Criterion for Transmitting a Fatwa

Question:
He says: If a person asks me about an issue, and I have heard a fatwa on the radio regarding exactly the same issue, am I permitted to issue a fatwa to him based on what I heard?

Answer:
Yes, attribute it to its source and say: I heard so-and-so on *Nur 'ala al-Darb*, or on any radio station, say: I heard so-and-so issue a fatwa stating such-and-such, provided that you know this with certainty, have memorized it, understood it, and have insight into the matter. Say: I heard so-and-so, Shaykh so-and-so issued a fatwa stating such-and-such, so that you fulfill the obligatory duty with insight and so that you are free from responsibility.
However, if you have doubt, or have not memorized it well, or have hesitation, or the like, then no. Do not issue a fatwa to anyone except with knowledge, except based on knowledge you have from Allah and from the Messenger (peace and blessings be upon him). Beware, for issuing a fatwa without knowledge carries great danger and a major sin. We ask Allah for safety.
