Question:
The questioner asks His Eminence the Shaykh, along with the people who ask about shighar marriage, for your guidance, and how shighar is carried out?
Answer: Shighar marriage is forbidden, not permissible, and invalid according to the correct view, even if a mahr is named in it; because the Messenger of Allah (peace and blessings be upon him) prohibited it in many hadiths. Shighar is when a man says: “Marry me to your daughter and I will marry you to my daughter,” or “Marry me to your daughter and I will marry you to my sister,” or “Marry me to your sister and I will marry you to my sister.” This is called shighar. It involves conditioning the marriage of one woman with the marriage of another. This is shighar, meaning conditioning this man’s sister or daughter, or this man’s daughter and that man’s sister. This is shighar. When the Prophet (peace and blessings be upon him) prohibited shighar, he said:
And shighar is when a man says: "Marry me to your daughter and I will marry you to my daughter," or "Marry me to your sister and I will marry you to my sister"والشغار أن يقول الرجل: زوجني بنتك وأزوجك بنتي، أو زوجني أختك وأزوجك أختي
This is shighar: conditioning one contract within another, even if they name a mahr.
Therefore, it is obligatory to be cautious of this and not to do it. However, if he proposes to him and does not condition anything, and the other proposes and they get married, there is no harm. He proposes to his daughter and the other proposes to his daughter or his sister, and they get married without any condition; this is fine, there is no blame.
