Question:
We have in our hospital—and in all hospitals—some medications used to treat pain after surgeries, as well as to treat various pains. These medications contain narcotic and alcoholic substances in varying proportions. If there is a legal concern regarding their use, is there a positive fatwa to consider them and present them to the responsible authorities at the time of their distribution?
Answer:
In the name of Allah, the Most Gracious, the Most Merciful. And may peace and blessings be upon the Messenger of Allah.
Medications that provide relief to the patient and alleviate his pain are permissible, and there is no harm in using them before or after the surgery. However, if it is known that they are made from an intoxicating substance, or from a substance whose large quantity intoxicates, they must not be used; because the Prophet (peace and blessings be upon him) said:Jami` at-Tirmidhi 1865Hasan (Darussalam). But if they do not intoxicate, and their large quantity does not intoxicate, but they provide some relaxation and anesthesia to alleviate pain, then there is no harm in that.
What is forbidden is that the substance be intoxicating, removing reason, or that its large quantity intoxicates. If its large quantity intoxicates, then both its small and large quantities are forbidden. As for what alleviates pain and facilitates the patient’s performance of the surgery—such as anesthesia and the like—there is no harm in that.
