What is the ruling on donating organs?

Machine translationRead the Arabic original
Question:
Did the Committee of Senior Scholars issue a fatwa stating that organ donation is not permissible? If so, what is the evidence?

Answer:
This is a matter on which scholars disagree: some have permitted it, while others have refrained from ruling on it. Organ donation includes the kidney, the heart, the hand, the leg, or other parts. I do not recall a decision being issued by the Committee on this matter. As far as I remember, the Committee of Senior Scholars refrained from ruling on it, and I am not aware of any decision currently permitting it.
I am also refraining from ruling on this; because I see that there is a fear that this may be considered mutilation. When one donates his kidney, or his heart if he dies, or his hand, or his leg: I fear that this may be among the acts of mutilation about which the Shari'ah has prohibited.
Some scholars and our brothers have issued a fatwa on this: at the time of death, if one bequeaths it, there is no blame in doing so.
The issue is a matter for consideration and reflection. In my view, the most cautious course is not to donate anything, not to allow anyone to cut it out after one's death, and not to be subjected to it.
