Ruling on Remarrying a Divorced Woman Through a Dissolving Husband

Machine translationRead the Arabic original
This is a message received by the program from Yusray 'Abd al-Nabi Ghazi, an Egyptian from Kafr al-Shaykh, residing in the Eastern Region. In his long message, he says: My brother divorced his wife three times because she works as a nurse at a clinic in Cairo. Outside of working hours, she would go to her apartment to administer injections to men and women, and she would go to some apartments to give injections, and Allah knows whether they were women or men. Some men would come to her at two in the morning and say, "Bring us so-and-so, she is feeling unwell." She would go out without her husband's permission, and he was not pleased with that. He divorced her twice for this reason. When she repeated it, specifically administering injections to men, he would say to her, "Do not go out." She would say to him, "I will go out despite you, and you have no authority over me." This was the situation. When she was divorced, she would kiss his feet and show regret, so he took her back twice. This time, on the third divorce, she wants to return, and she wants to find a dissolving husband so she can return to her husband, but to no avail, because she has been divorced three times. Please advise us, may Allah reward you, about her situation?
Answer: After the third divorce, there is no return except after a lawful husband. The dissolving husband is not permissible. The dissolving husband is a borrowed donkey, and he is cursed. His marriage is not permissible, it is invalid, and it does not achieve the dissolution. A wife like this is not desirable, even if she marries another man. This husband should not return to her and should not desire her, because she is suspected of evil as long as she engages in these actions. It is not fitting for him to return to her; rather, he should seek another woman who is better than her:
And whoever fears Allah - He will make for him a way outوَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مَخْرَجًا
[Al-Talaq:2] ..
And whoever fears Allah - He will make for him of his matter ease.وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مِنْ أَمْرِهِ يُسْرًا
[Al-Talaq:4].
This woman is suspected of evil, so it is not fitting for him to return to her even if she marries. She is not lawful for him until she marries another man in a lawful marriage, not a dissolution. The new husband must have intercourse with her, then part from her by death or divorce, and then she must observe the waiting period. However, as long as she has the character described by the questioner, he should not return to her, because her appearance is evil and because she is suspected of evil. We ask Allah for safety and well-being.
The presenter: May Allah reward you.
