Answer: A bequest is always prescribed if a person has something to bequeath. He should hasten to make it, based on what is established from him (peace and blessings be upon him) that he said:Sahih Muslim 1627a It was narrated by the two Shaykhs, al-Bukhari and Muslim, in the two Sahihs. This indicates that it is prescribed for him to hasten with the bequest if he has something he wishes to bequeath.
The maximum permissible amount is only one-third. If he bequeaths one-quarter, one-fifth, or less, there is no harm, but the maximum permissible is one-third, based on the saying of the Prophet (peace and blessings be upon him) in the hadith of Sa'd Ibn 'Abbas said: Sunan al-Bayhaqi 10:37 because the Messenger (peace be upon him) said: , and al-Ṣiddiq (may Allah be pleased with him) bequeathed one-fifth.
