Ruling on Repeating an Oath on a Single Matter

The first message in this episode came from Sulaymaniyah in Iraq, from Khalid Khalil Khayri. He says: I have sworn by the Great Qur'an more than three times, or perhaps fewer—I am not entirely sure, as this has been going on for a long time. I swore that I would avoid zina (unlawful sexual intercourse); but I have not been able to control myself. My wife is the cause of these situations for me, because she knows absolutely nothing about marital duties, which has made me dislike and hate her. I have five children from her. What is the expiation for each oath? Does the expiation erase my sin, the sin for which I swore? And does Allah (Mighty and Majestic) remain angry with me, knowing that I pray and fast the month of Ramadan every year? I am always thinking of the punishment of Allah, but the soul is inclined to evil. Please advise us, may Allah reward you.
Answer: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and blessings and peace be upon His servant and our Prophet Muhammad, and upon his family and his Companions, and upon those who follow his path and are guided by his guidance until the Day of Judgment.
As for what follows: There is no doubt that zina (unlawful sexual intercourse) is among the ugliest of major sins and among the greatest of evil deeds. Therefore, it is obligatory for you, O questioner, to repent to Allah from that, and to strive against your soul so that you do not fall into this great sin. Allah (Glorified and Exalted is He) says:
And do not approach unlawful sexual intercourse. Indeed, it is ever an immorality and is evil as a way.وَلا تَقْرَبُوا الزِّنَى إِنَّهُ كَانَ فَاحِشَةً وَسَاءَ سَبِيلًا
[Al-Isra: 32]. And He says (Glorified and Exalted is He):
(68) And those who do not invoke with Allah another deity or kill the soul which Allah has forbidden [to be killed], except by right, and do not commit unlawful sexual intercourse. And whoever should do that will meet a penalty. (69) Multiplied for him is the punishment on the Day of Resurrection, and he will abide therein humiliated - (70) Except for those who repent, believe and do righteous work. For them Allah will replace their evil deeds with good. And ever is Allah Forgiving and Merciful.وَالَّذِينَ لا يَدْعُونَ مَعَ اللَّهِ إِلَهًا آخَرَ وَلا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلَّا بِالْحَقِّ وَلا يَزْنُونَ وَمَنْ يَفْعَلْ ذَلِكَ يَلْقَ أَثَامًا ۝ يُضَاعَفْ لَهُ الْعَذَابُ يَوْمَ الْقِيَامَةِ وَيَخْلُدْ فِيهِ مُهَانًا ۝ إِلَّا مَنْ تَابَ وَآمَنَ وَعَمِلَ عَمَلًا صَالِحًا فَأُوْلَئِكَ يُبَدِّلُ اللَّهُ سَيِّئَاتِهِمْ حَسَنَاتٍ وَكَانَ اللَّهُ غَفُورًا رَحِيمًا
[Al-Furqan: 70].
So you, O questioner, must repent to Allah and hasten in doing so, and strive against your soul with great effort, so that you are safe from this great calamity, this major misfortune, and this serious danger. You must also pay the expiation for the oath you took by the Qur'an that you would not commit zina (unlawful sexual intercourse). It is a single expiation, if the oath was one that you repeated, saying: "By the Qur'an, I will not commit zina," "By the Qur'an, I will not commit zina," "By the Qur'an, I will not commit zina," even if you repeat it many times, it is a single expiation. Likewise, if a person says: "By Allah, I will not speak to so-and-so," "By Allah, I will not speak to so-and-so," "By Allah, I will not speak to so-and-so," then he owes a single expiation, if the oath is repeated on a single matter, its expiation is one. Likewise, if you say: "By Allah, I will not visit so-and-so," "By Allah, I will not visit so-and-so," "By Allah, I will not visit so-and-so," then it is a single expiation if you visit him, provided you were denying it by saying "By Allah, I will not visit him" and then you visited him, it is a single expiation.
The expiation is not sufficient in place of repentance. You must pay the expiation for your oath, and you must repent from zina (unlawful sexual intercourse). This means sincere repentance, which entails regret for the past sins, abandoning them, and not returning to this matter, with a sincere resolve to do so. This is repentance, and it encompasses three things:
The first thing: Abandoning the disobedience and guarding against it, out of reverence for Allah and fear of Him (Glorified and Exalted is He).
The second thing: Regret for the past, sincere regret, and sorrow for the evil deeds you have done in the past.
The third thing: A sincere resolve not to return to it.
Whoever repents, Allah will accept his repentance. As for the expiation, it is not sufficient on its own. Beware, O servant of Allah, that your term of life may overtake you while you are in this bad state, for the evil of zina (unlawful sexual intercourse) is great and its consequence is severe. As for the wife, if she is not suitable for you and you do not love her, then praise be to Allah, you have a way out: divorce her and seek another woman who is suitable, perhaps Allah will make her a means for you to avoid the sin. Allah has made divorce a mercy for His servants when there is a need for it. So divorce her with a single pronouncement of divorce and seek another, and be glad of good if you are sincere and seek the good. Be glad of good:
And whoever fears Allah, He will make for him a way out, and will provide for him from where he does not expect. And whoever fears Allah, He will make ease for him in his affairs.وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مَخْرَجًا ۝ وَيَرْزُقْهُ مِنْ حَيْثُ لا يَحْتَسِبُ ۝ وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مِنْ أَمْرِهِ يُسْرًا
[At-Talaq: 2-4]. This is the speech of our Lord (Mighty and Majestic), and He is the Truthful (Glorified and Exalted is He). So fear Allah, watch over your obedience to Allah, and beware of His anger. And beware of meeting your Lord while you are in this sin. We ask Allah for guidance and sincere repentance for us and for you. Yes.
