He evaded me many times, so I pronounced a divorce on the condition that I would not record a tape after that for as long as I remain in the Kingdom. However, he says: 'After that, I retracted my words and recorded tapes.' Will this divorce be considered to have taken effect?"
Answer: If the intention behind the divorce regarding the recording was to prevent yourself from recording, and you did not intend to part from your wife if you recorded, but rather intended to restrain yourself so that you would not record again, then this divorce is ruled as an oath. However, if you intended to effectuate the divorce, then the divorce takes effect if you record. Since you are in the Kingdom, you can ask one of the judges or one of the scholars, with your wife and her guardian (if he is present), so that the matter becomes clear to you and to her in this case and the one before it. Or, if you are in Riyadh, you can come to us so that we may ask you about what is required. In any case, the answer is what you have heard. Yes.
