The listener Salim Muhammad Salim from the Arab Republic of Egypt, Sohag, sent a message saying: I warn and advise my family and some Muslims against falling into religious innovations and superstitions, such as visiting the shrines of the dead, women going to graves, and holding the innovation of the mourning ceremony, such as hiring reciters for the deceased. Then some students came to me and said: You are doing what the mufti does, and the Messenger (peace and blessings be upon him) said:
The boldest of you in issuing fatwas is the boldest of you in entering the Fireأجرؤكم في الفتوى أجرؤكم على النار
, or as it was reported from the Messenger (peace and blessings be upon him). Is what my companion said correct? May Allah reward you with good.
Answer: It is obligatory for the Muslim to call people to Allahand to clarify to his Muslim brothers what is obligatory for them and what is forbidden for them, and to enjoin what is right and forbid what is wrong if he has knowledge and insight; because Allah commanded His Muslim servants to call people to Allah, and commanded them to enjoin what is right and forbid what is wrong, and commanded them to cooperate in righteousness and piety. Allah the Exalted said::
cooperate in righteousness and pietyوَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَى
[Surah al-Ma'idah: 2], and He the Exalted said:
The believing men and believing women are allies of one another. They enjoin what is right and forbid what is wrongوَالْمُؤْمِنُونَ وَالْمُؤْمِنَاتُ بَعْضُهُمْ أَوْلِيَاءُ بَعْضٍ يَأْمُرُونَ بِالْمَعْرُوفِ وَيَنْهَوْنَ عَنِ الْمُنكَر
[Surah al-Tawbah: 71], and He (peace and blessings be upon him) said::
Invite to the way of your Lord with wisdom and good instruction, and argue with them in a way that is bestادْعُ إِلَى سَبِيلِ رَبِّكَ بِالْحِكْمَةِ وَالْمَوْعِظَةِ الْحَسَنَةِ وَجَادِلْهُمْ بِالَّتِي هِيَ أَحْسَنُ
[Surah al-Nahl: 125]. So if the Muslim man or woman has knowledge and insight, then it is obligatory for them to call people to Allah, and to make people aware of what is obligatory for them and what is forbidden for them, just as they call the disbelievers to Allah, guide them to the religion of Islam, and clarify to them its virtues and rulings.
So likewise with their Muslim brothers, men and women call them to Allah, advise them, and direct them to good. The greatest of this is what concerns disbelief, shirk (associating partners with Allah), and creed. This includes advising those who worship graves, who call upon the dead, who prostrate before the shrines, and who ask the dead to fulfill a need, cure a sick person, return an absent person, or the like. This is disbelief in Allah, this is worship of idols, and this is the shirk of the pre-Islamic age of ignorance. Likewise, the Prophet (peace and blessings be upon him) forbade women from visiting graves and cursed the women who visit graves. So if he advises them for the sake of Allah and says: This is not permissible, do not visit the graves, then he has done well. Likewise, forbidding the visiting of the people of innovation and acting upon what they say, except if they visit them to advise them, to call them to Allah, and to teach them the evil of the innovations they are upon, if he has knowledge. Then he is rewarded, and this is jihad in the path of Allah, because he enjoins what is right and forbids what is wrong, and visits the people of innovation to call to Allah, teach them the truth, and deny the innovation upon them by appropriate means, so that perhaps Allah will guide them through his hands. This is rewarded, and this is jihad in the path of Allah. And the one who forbids them from that has erred. The one who forbids the scholars from calling to Allah has erred and is wrong. Rather, it is the duty of the scholars to call to Allah, to teach people good, to guide them to the obedience of Allah and His Messenger, to warn them of innovations and their people, to command them to have tawhid (the oneness of Allah) and sincerity to Him, and to warn them of shirk (associating partners with Allah), which is the work of the pre-Islamic age of ignorance and the work of those who worship idols.
As for the hadith:
The boldest of you in issuing fatwas is the boldest of you in entering the Fireأجرؤكم على الفتيا أجرؤكم على النار
, it is a mursal (a report missing the Companion link) and is not established from the Prophet (peace and blessings be upon him). Rather, it is mursal, narrated by ad-Darimi from 'Ubaydullah ibn Abi Ja'far from the Prophet (peace and blessings be upon him). And 'Ubaydullah ibn Abi Ja'far is a Tabi'i (from the generation after the Companions), not a Companion, so it is mursal. 'Ubaydullah (may Allah have mercy on him) said about the Prophet (peace be upon him) that he said:
The boldest of you in issuing fatwas is the boldest of you in entering the Fireأجرؤكم على الفتيا أجرؤكم على النار
. And if this were authentic, the intended meaning is warning against issuing fatwas without knowledge. As for issuing fatwas with knowledge, it is obligatory. People should clarify to the scholars that they should clarify and call to Allah the Glorious and Exalted. And Allah sent the messengers as callers who clarify the truth, and likewise their followers, the scholars, are the successors of the messengers. It is upon them to clarify the truth and to issue fatwas with the truth. As for the one who does not have knowledge, he has no right to speak except with knowledge. Allah the Glorious and Exalted said in His great Book:
Say, "My Lord has only forbidden immoralities - what is apparent of them and what is concealed - and sin, and oppression without right, and that you associate with Allah that for which He has not sent down authority, and that you say about Allah that which you do not know."قُلْ إِنَّمَا حَرَّمَ رَبِّيَ الْفَوَاحِشَ مَا ظَهَرَ مِنْهَا وَمَا بَطَنَ وَالإِثْمَ وَالْبَغْيَ بِغَيْرِ الْحَقِّ وَأَنْ تُشْرِكُوا بِاللَّهِ مَا لَمْ يُنَزِّلْ بِهِ سُلْطَانًا وَأَنْ تَقُولُوا عَلَى اللَّهِ مَا لا تَعْلَمُونَ
[Al-A'raf: 33], so He made his saying about Allah without knowledge above the rank of shirk (associating partners with Allah), because of its great danger, and because shirk is saying about Allah without knowledge. And He the Exalted and Majestic also said in His noble Book:
(168) O mankind, eat from whatever is on earth [that is] lawful and good and do not follow the footsteps of Satan. Indeed, he is to you a clear enemy. (169) He only orders you to evil and immorality and to say about Allah what you do not know.يَا أَيُّهَا النَّاسُ كُلُوا مِمَّا فِي الأَرْضِ حَلالًا طَيِّبًا وَلا تَتَّبِعُوا خُطُوَاتِ الشَّيْطَانِ إِنَّهُ لَكُمْ عَدُوٌّ مُبِينٌ ۝ إِنَّمَا يَأْمُرُكُمْ بِالسُّوءِ وَالْفَحْشَاءِ وَأَنْ تَقُولُوا عَلَى اللَّهِ مَا لا تَعْلَمُونَ
[Al-Baqarah: 168-169], so He the Exalted informed that Satan deceives people by saying about Allah without knowledge.
So it is obligatory to be cautious of saying about Allah without knowledge. And Allah has forbidden it and warned against it, and informed that it is in a rank above shirk (associating partners with Allah), and informed that it is among what Satan commands. So it is obligatory for the scholars to clarify and to be discerning, and for the callers to Allah, the muftis, not to speak except with knowledge and not to issue fatwas except with knowledge, because of these noble verses and other evidence indicating the prohibition of saying about Allah without knowledge. And Allah is the One to be asked for help.
