The listener Mahmoud Ahmad Routha sent a message containing three questions. In one of them, he says: Some hadiths mention the zakah of buried treasure (rikaz). What is rikaz?
Answer: Rikaz is the wealth buried by the people of the pre-Islamic age of ignorance (jahiliyyah), which is found in some ruins or in some deserts, buried by the people of the pre-Islamic age of ignorance. It bears the marks of the disbelievers of the pre-Islamic age, whether it is gold, silver, vessels, weapons, or other wealth. It is buried in the ground with a mark indicating that it is from the burial of the pre-Islamic age, bearing the mark of the disbelieving state, meaning the mark of the disbelievers. This is called rikaz, meaning it is fixed in the ground, meaning it is buried in it. Rikaz means fixed. The meaning is that he finds it buried in the ground; it is not a mine, no, it is buried. In this case, one-fifth belongs to the one in authority (wali al-amr) if it is in Islamic lands; the one in authority gives the one-fifth. If it is in non-Islamic lands, he gives the one-fifth in charity. He gives the one-fifth in charity to the poor, and the four-fifths are for him. The one-fifth is like zakah; it is given in charity to the poor. If it is in Islamic lands where there is a Muslim governor, he gives it to him for the public treasury (Bayt al-Mal), and the four-fifths are for him. This is called rikaz.
As for the mine, which is from the original earth, a mine of gold or silver, this is not called rikaz. This belongs to the one who extracts it. Whoever extracts it, it is for him. If he extracts gold that reaches the minimum threshold (nisab), he pays its zakah when a lunar year of possession (hawl) has passed over it. Or if he extracts silver, he pays its zakah when a lunar year of possession has passed over it. As for if it is another type of mineral, such as sulfur or something else, it is for him. What he takes from this mineral is for him, if it is in dead land that is not owned by anyone. Yes.
