Ruling on preventing a son from taking what his father endowed for shrines

Machine translationRead the Arabic original
Question:
This questioner says—O Shaykh—from Sudan: Is it permissible for me to prevent the gift, such as the date palms, that my grandfather gave as a means of drawing near to the Sayyid or the wali?

Answer:
If your grandfather or your father endowed date palms, or a house, for the shrine of so-and-so, to be built upon it, or to be spent on perfuming the place, or building on it, or plastering it, or the like, then the endowment is invalid. This endowment is invalid, and it belongs to the heirs. It becomes an invalid endowment and belongs to the heirs, and it is not relied upon. This is due to the saying of the Prophet (peace and blessings be upon him):
He who did any act for which there is no sanction from our behalf, that is to be rejected.من عمل عملًا ليس عليه أمرنا فهو رد
Sahih Muslim 1718b
And he (peace and blessings be upon him) said:
'A'isha reported Allah's Messenger (ﷺ) as saying: He who innovates things in our affairs for which there is no valid (reason) (commits sin) and these are to be rejected.من أحدث في أمرنا هذا ما ليس منه فهو رد
Sahih Muslim 1718a
Therefore, endowments must be in accordance with the Shari'ah. An endowment that does not conform to the Shari'ah is invalid.

The presenter: May Allah reward you.
