What is the punishment for one who abandons prayer out of laziness?

Machine translationRead the Arabic original
Question:
Your Eminence! Our brother Faisal Ahmad Abdullah from Hail asks: Please clarify the punishment for one who abandons prayer while believing in its obligation, and please clarify for you, may Allah protect you, the virtue of the Fajr prayer, and the punishment for one who does not perform it in its time. May Allah reward you with good.

Answer:
If one abandons prayer, his punishment is execution. He is given the opportunity to repent; if he repents, well and good, otherwise he is executed. Allah the Exalted said:
But if they should repent, establish prayer, and give zakah, let them [go] on their wayفَإِنْ تَابُوا وَأَقَامُوا الصَّلاةَ وَآتَوُا الزَّكَاةَ فَخَلُّوا سَبِيلَهُمْ
[Surah al-Tawbah: 5], which indicates that one who does not establish prayer is not left alone but is executed. He is given the opportunity to repent; if he repents, well and good, otherwise he is executed. And he (peace and blessings be upon him) said:
I have been prohibited from killing people who pray.إني نهيت عن قتل المصلين
Sunan Abi Dawud 4928Sahih (Al-Albani)
So the one who prays is not executed if he is upright. As for the one who abandons prayer, he is given the opportunity to repent; if he repents, well and good, otherwise it is obligatory to execute him as an apostate according to the most correct of the two opinions. According to a group of scholars, he is not considered an apostate, but his execution is a hadd (fixed punishment). If we say that abandoning it is not major shirk (associating partners with Allah) when he acknowledges its obligation and does not deny it, the correct view is: he is executed for disbelief if he is one who abandons it and is given the opportunity to repent; if he repents, well and good, otherwise he is executed for disbelief, not as a hadd. It is extremely unlikely that one would acknowledge its obligation and then persist in not performing it until he is executed. This is extremely unlikely.
The point is that he is executed for disbelief absolutely, as long as he refuses to pray and is given the opportunity to repent but refuses; then he is executed for disbelief. We ask Allah for well-being. He is not a Muslim, whether the prayer is Fajr, Zuhr, 'Asr, Maghrib, or 'Isha. Fajr has a special status because the hypocrites are lazy about it, and many hadiths have come regarding it. For this reason, he (peace and blessings be upon him) said:
The most burdensome prayers for the hypocrites are the 'Isha' prayer and the Fajr prayer. If only they knew what (reward) there is in them, they would come to them even if they had to crawl.أثقل الصلاة على المنافقين صلاة العشاء وصلاة الفجر، ولو يعلمون ما فيهما لأتوهما ولو حبوًا
Sunan Ibn Majah 797Sahih (Darussalam)
, and he (peace and blessings be upon him) said:
He who observed the morning prayer (in congregation), he is in fact under the protection of Allah and it never happens that Allah should make a demand in connection with the protection (that He guarantees and should not get it) for when he asks for anything in relation to His protection, he definitely secures it. He then throws him flatly in the Hell-fire.من صلى الصبح فهو في ذمة الله فلا يطلبنكم الله بشيء من ذمته، فإنه من يطلبه شيئًا من ذمته يدركه، ثم يكبه في النار
Sahih Muslim 657b
.
Prayer has a great status, whether it is Fajr, Zuhr, 'Asr, Maghrib, or 'Isha. However, Fajr has specific characteristics because it occurs at the end of the night, when sleep is sweet in the summer and the cold is severe in the winter. So the lazy may be heavy about it and resemble the people of hypocrisy. Therefore, there is emphasis on it. It is obligatory for the believer to take care of it so that he distances himself from resembling the hypocrites. It is not permissible for him to abandon it until the sun rises, as some people do, praying it when they get up for work. This is a great abomination and a widespread evil. It is obligatory for its owner to fear Allah and to pray it in its time with the Muslims in the congregation of the Muslims in the mosques of Allah. And whoever knows this must give him the opportunity to repent; if he repents, well and good, otherwise he is executed; because abandoning it until its time passes is a great abomination, and indeed disbelief according to a group of scholars if he does it intentionally. We ask Allah for guidance and safety for everyone.
