Question:
We conclude this episode with a message received by the program from one of the female listeners from Iraq. She says: I am the listener from the Republic of Iraq: Ahlam Ibrahim Muhammad. An Islamic greeting from the depths of my heart, in which I wish you further progress toward what is good and best for Islam and Muslims. Please note that I sent you a previous message and did not hear your response. I ask you to answer my questions for the sake of Islam and Muslims, and I offer you my sincere thanks.
She asks and says: Is it permissible for a menstruating woman to enter the cemetery?
And is it permissible for her to recite the azim from the chapters of the Qur'an for others while she is in that state?
Answer:
As for her going to the cemetery, no, it is not prescribed for her to go to the cemetery; because the Messenger of Allah (peace and blessings be upon him) However, if she passes by the cemetery out of necessity, on a road, there is no difference between her being menstruating or not; her passing by the cemetery out of necessity on a road, going to a place or returning from a place, does no harm. As for visiting it with the intention of visiting, it is not permissible, whether she is in a state of purity, menstruating, or experiencing post-natal bleeding. Women are not permitted to visit graves in any case.
As for writing the azim, or reciting the azim from the Qur'an, the scholars differed on this: whether she may recite the Qur'an while menstruating or experiencing post-natal bleeding, on two opinions:
Some mentioned the prohibition, and that is the opinion of the majority of the scholars of knowledge; because she has committed a major ritual impurity, which requires her to perform the full ritual bath when she becomes pure, so she is like one in a state of major ritual impurity. One in a state of major ritual impurity is not permitted to recite the Qur'an or touch the mushaf until he performs the full ritual bath. They compared her to one in a state of major ritual impurity, and so is the woman experiencing post-natal bleeding.
And others among the scholars of knowledge said: No, she is not like one in a state of major ritual impurity. One in a state of major ritual impurity can perform the full ritual bath immediately and recite. As for the menstruating woman, she does not resemble him; because she remains in that state for a period, and so is the woman experiencing post-natal bleeding, who is in need of reciting the Qur'an.
So the correct view is that it is permissible for her to recite from memory, and so by way of touching the mushaf through a barrier, such as if she has gloves or a garment or something else, she holds the mushaf with it, so it is through the barrier, out of necessity for that. As for touching it directly, she is not permitted to touch the mushaf, just as one in a state of minor ritual impurity is not permitted to touch the mushaf.
As for what was reported that the Prophet (peace and blessings be upon him) said:Jami` at-Tirmidhi 131Da'if (Darussalam), it is a weak hadith according to the scholars of knowledge, and it does not serve as a proof. The correct view is that she may recite, and so may the woman experiencing post-natal bleeding; because their periods are long, so they are not like one in a state of major ritual impurity. As for one in a state of major ritual impurity, he is not permitted to recite, neither from the mushaf nor from memory, until he performs the full ritual bath. This is the correct view, and success is from Allah.
