Question:
As you know, we face problems from some deviants and criminals, and sometimes the situation necessitates that during the investigation with any category of these people, I reach out to the accused and hit him, especially after I am convinced by all the evidence that the accused is guilty, and given the evasiveness and attempt to mislead justice that I observe in him, am I accountable before Allah (Glorified and Exalted is He)?

Answer:
It has been stated that you are not to do anything other than what you have in your instructions, and you are not to act on your own initiative or add anything. You must carry out the instructions you have regarding the accused and the non-accused, and you are not to add any beating or anything else. However, the one present sees what the one absent does not see. If he tries to slip away from you and flee, you may restrain him, and you may seek the help of whoever helps you against him. If he reaches out his hand, you may only meet him with retaliation in kind, with no excess.
As for doing whatever you want of beating, cursing, or insulting, that is not allowed. You are not to curse, nor insult, nor reach out your hand except for the right of self-defense only, just as the Prophet (peace and blessings be upon him) said:
When two persons indulge in hurling (abuses) upon one another, it would be the first one who would be the sinner so long as the oppressed does not transgress the limits.المُسْتَبَّان ما قالا فعلى البادئ، ما لم يعتدِ المظلوم

, and you are not to exceed retaliation in kind. You are only to carry out the instructions you have, which contain absolutely nothing that contradicts the Shari'ah.
