What is the ruling on a person asking the accused, in whom he has doubts, to take an oath?

The questioner : Shaykh, do you remember the young man... regarding the third wife, and he suspects one of them, but he cannot, meaning he says to him, "You..." So he said to me, "Is it permissible for me to ask the five, or more, or fewer, to swear an oath? Is it prescribed for him to have them swear, meaning for one of them?"

The Shaykh : There is no precedent in the first instance. First, and second: the accused may actually be compelled to swear falsely; therefore, we do not recommend this.

The questioner : I mean, what do you advise this man to do to help him? For example, he says, "I mean, I suspect so-and-so, and so-and-so should..."

The Shaykh : If his suspicion is strong, he should investigate privately with him, above all, based on what he hears from him; this may strengthen or weaken [the suspicion].

The questioner : In that case, he asks him. May Allah reward you with good, our Shaykh.

The Shaykh : You are welcome.

The questioner : And may Allah bless you, and peace be upon you and the mercy of Allah and His blessings.

The Shaykh : And upon you be peace. Is there any need?
