Ruling on the inheritance of one to whom the state pays an annual sum

Question:
A man passed away, leaving behind two sons, two daughters, and one wife. There is money that is given to this deceased man every year by the state. Does the mother of the children have a right to this money, knowing that she married after his death and gave birth? Please give us a ruling, and may Allah reward you.

Answer:
The money is their estate, and likewise what the state disburses is among the heirs. This is the legal principle, except for what the state has agreed with the employees to be for some of the heirs and not others, under a system regarding retirement. That is a different matter; it is according to what the state has established, because it is assistance from them based on the system they established. So it is given to the one whom the state has approved to receive it, and the others are left out. As for what is a monthly assistance other than retirement, or assistance from the state to him that is not under the retirement system, all of that is among the heirs: the wife and other than the wife.
