Question:
A letter reached the program from Sharurah, sent by a listener from there. He says: Your brother (Faraj M. Al-Mari), our brother, says: I am a man who loves the scholars of the Muslims, and I love doing good, and this is from the favor of my Lord, and praise be to Allah. But when I got married, I was in the greatest need for money in order to complete what I needed. So I went to one of the brothers and asked him for a loan. He agreed, but on the condition that I take five thousand riyals from him and return them to him after six months as seven thousand five hundred riyals, meaning: with an increase of two thousand five hundred riyals. And due to my pressing need, I took this amount while I was reluctant. I have paid the amount, meaning: I returned it after six months according to the condition, and I have some hesitation in my mind. So is there a sin on me? Because I fear that I may have taken riba. I ask you to issue a ruling for me? May Allah reward you with good.

Answer:
There is no doubt that this transaction is a riba transaction, and it is forbidden, and it is a sin upon you and upon your partner. So it is obligatory for both of you to repent to Allah and to feel regret for what has passed, and to resolve not to return to that. And it is obligatory for your partner to return to you the excess amount of two thousand five hundred; because it is not lawful for him, rather it is riba. So it is obligatory for him to return it to you, unless you forgive it and permit it for him; because it is a riba transaction and he has no right to take this increase. And the Prophet (peace and blessings be upon him) said:
Gold is to be paid for by gold, silver by silver, wheat by wheat, barley by barley, dates by dates, and salt by salt, like for like and equal for equal, payment being made hand to handالذهب بالذهب، والفضة بالفضة، والبر بالبر، والشعير بالشعير، والتمر بالتمر، والملح بالملح مثلاً بمثل، سواءً بسواء، يدًا بيد، فمن زاد أو استزاد فقد أربى

And this transaction has been established in the place of gold and silver.
So he has no right to take the increase. He has no right to sell ten for twelve, or to lend ten for twelve, or for thirteen, or for more. All of this is not permissible; because it is from riba. So you must repent, and he must repent, and feel regret for what has passed and resolve not to return to that. And he must return to you what was in excess of the five; because it was taken without right. But if you permit it for him and forgive it as a favor from you, there is no harm.
