Question:
What is the ruling if we see a disbeliever doing the action of the man with the Companion, and he wanted to save himself and said: "La ilaha illa Allah," and Allah knows best about his intention?

Answer:
He is not to be killed if he says it, whereas he did not say it previously, until it is verified regarding his case, even if it is suspected that he said it as a means of seeking refuge, just as the Prophet (peace and blessings be upon him) rebuked Usamah when Usamah said to the Prophet (peace and blessings be upon him): "He only said it as a means of seeking refuge." He said to him:
Have you split open his heart?أشققتَ عن قلبه
? If he did not say it at all and then said it, he is to be held back until his case is examined.
