Maintenance for Children After the Divorce of Their Mother

Machine translationRead the Arabic original
Question:
The woman does not love her husband, and he is the same, as you say. So she asks: Does the Shari'ah obligate the husband to spend on her and on their children from him after the divorce in a separate house, or not?

Answer:
If they separate, they must agree on the matter of the children's maintenance. Their circumstances are examined in the court. They agree with her guardian regarding the required monthly maintenance, and praise be to Allah. If they dispute, they return to the court. The court examines the case and determines the necessary maintenance. However, the better option is reconciliation; reconciliation is better than the court. They agree on suitable maintenance that he spends on his children if he has divorced her and she has children with him. This is the better course. If they dispute, they return to the court. No one other than the court can examine this matter.
