The Ruling on Separating from a Wife Who Abandons Prayer

The questioner: He says: This wife to whom I am currently married does not obey my command and does not perform the prayer. This was a condition for me before the marriage contract, but after the contract she rebelled against me, so I have left her for fifteen months. What is the ruling of the Shari'ah regarding this wife who rebels against me? Please give us a ruling?
Answer: The one who does not pray is not considered a Muslim, but is considered a disbeliever in the most correct of the scholars' opinions; because abandoning the prayer is major shirk (associating partners with Allah); because it is the pillar of Islam. And it is authentic from the Messenger of Allah (peace and blessings be upon him) that he said:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها فقد كفر
Sunan Ibn Majah 1079Sahih (Darussalam)
This includes men and women, and the correct view is that it is major shirk (associating partners with Allah), this is the truth, and it is what the Companions of the Prophet (peace and blessings be upon him) agreed upon, as Abdullah ibn Shaqiq al-'Uqayli said:
The Companions of the Messenger of Allah (peace and blessings be upon him) did not consider anything abandoned to be disbelief except the prayerلم يكن أصحاب رسول الله ﷺ يرون شيئاً تركه كفر إلا الصلاة
This indicates that they agreed upon this , so the one who does not pray has no good in her, rather you must separate from her completely. Allah said:
they are not lawful [wives] for them, nor are they lawful [husbands] for themلا هُنَّ حِلٌّ لَهُمْ وَلا هُمْ يَحِلُّونَ لَهُنَّ
[Al-Mumtahanah:10] And He said:
And hold not to marriage bonds with disbelieving womenوَلا تُمْسِكُوا بِعِصَمِ الْكَوَافِرِ
[Al-Mumtahanah:10] So this woman has no good in her, rather it is obligatory to separate from her. Yes.
