Answer: A group of scholars have permitted this, stating that there is no harm in it. They argued that the Prophet (peace and blessings be upon him) said to the shepherds:
That they should postpone the eleventh day and stone it together with the twelfthأن يؤخروا اليوم الحادي عشر ويرموه مع الثاني عشر
. They said: This is a type of postponement due to the excuse of the shepherds. If the shepherds are excused because of tending the camels, then a person being excused because of his fear for his own life is even more so and more so. A person’s life is more precious and higher than a camel’s life. If tending to the camels and the interest of the camels and the interest of the pilgrims regarding their camels makes the shepherds stone at night and stone later, then a person’s fear for his own life is all the more an excuse. For this reason, a group of scholars have permitted postponing the stoning to the twelfth or thirteenth day, and then the pilgrim stones in order, starting with the Day of Sacrifice, then the eleventh, then the twelfth, then the thirteenth if he was delayed. All of this has no blame in it, if Allah wills, and there is no harm.
Likewise, a person delegating the stoning due to his inability, weakness, and fear for his own life, all of this is from the perspective of caring for public interests and repelling great harm. For the principle of the Shari'ah is: repelling harm, no harm and no reciprocating harm, and caring for public interests. It is known that the gathering of women and men between the passing of the sun from its zenith and the setting of the sun during the crowding of Hajj contains great dangers. If that is seen and permission is given for the woman to delegate, and for the old man and the like, then this becomes a relief for everyone and a facilitation for everyone. Yes.
