Our brother also asks and says: What is your opinion regarding the celebration of the noble Prophet's birthday? It has been repeated in the words of people that some scholars have permitted it and they perform it. Please inform us about this, may Allah reward you with good?
Answer: The celebration of the birthday has no basis; rather, it is among the religious innovations that people introduced in the fourth century and after. It is well known that the first to introduce it was the famous group known as the Fatimids, who were the rulers of the Maghreb and Egypt in the fourth and fifth centuries. They introduced it in the fourth century in the name of Ali, al-Hasan, al-Husayn, and Fatimah, and in the name of the Prophet (peace and blessings be upon him) and the name of their ruler. Then it spread after them. This was not in the blessed centuries, nor in the time of the Prophet (peace and blessings be upon him). Therefore, the meticulous scholars of knowledge mentioned that it is a religious innovation, due to the saying of the Prophet (peace and blessings be upon him):
He who did any act for which there is no sanction from our behalf, that is to be rejected.من عمل عملًا ليس عليه أمرنا فهو رد

and his saying (peace and blessings be upon him):
'A'isha reported Allah's Messenger (ﷺ) as saying: He who innovates things in our affairs for which there is no valid (reason) (commits sin) and these are to be rejected.من أحدث في أمرنا هذا ما ليس منه فهو رد

meaning: it is rejected.
There is no consideration for those who do it today and their large numbers, because they have inherited this from their predecessors. The principle that the common people and the disbelievers before the Prophet (peace and blessings be upon him) followed is
Indeed, we found our fathers upon a religion, and we are in their footsteps [rightly] guided."إِنَّا وَجَدْنَا آبَاءَنَا عَلَى أُمَّةٍ وَإِنَّا عَلَى آثَارِهِمْ مُقْتَدُونَ
[Surah al-Zukhruf: 23]. So there is no proof in following the fathers if their work is not on a solid foundation, not on evidence. Just as the deeds of the disbelievers are not a proof. For this reason, Allah refuted that and ordered them to follow the Prophet (peace and blessings be upon him), and did not make an excuse for them in following their predecessors, but rather He blamed them for it. So you, O believer, are likewise; it is not permissible for you to follow your father, nor your grandfather, nor the people of your land, except in what Allah has prescribed. As for what Allah has forbidden, it is not permissible for you to follow them even if they are many. If the people of your land start drinking intoxicants, it is not permissible for you to do it with them, even if they commit unlawful sexual intercourse, likewise. If they are undutiful to their parents, it is not permissible for you to do like them. So if they commit religious innovations, it is not permissible for you to follow them, but rather you call for their guidance, you advise them, and direct them to good, and you do not do with them what Allah has forbidden of religious innovation. Just as it is not permissible for you to do with them unlawful sexual intercourse, or intoxicants, or undutifulness to parents, or usury or interest, or what is similar to that. Yes.
