Ruling on divorcing a wife whose illness becomes apparent after marriage

The brother Ali Ibrahim Ali from Sudan has a second question in his letter. He says: My brother is married to his maternal cousin, and she has given birth to two children, but it has become apparent to him that she is suffering from a loathsome illness that doctors and the awliya (close friends of Allah) cannot cure, and they cast her into the fire. This brother is certain that this wife was ill before the marriage, but he did not know it. He wants to divorce her, so what is required of him?
Answer: There is no blame on him in divorcing her if he wishes to divorce her due to the aforementioned illness; there is nothing wrong with it. However, if she has no one to take care of her, provide for her, treat her, and be patient with her, then it is better for him to be patient and seek reward from Allah, so that he may protect her and shield her from falling into the fire and from what harms her. This is what he should do. A believer should show mercy to his wife, especially the mother of his children, and be kind to her until Allah cures her by His grace or chooses death for her.
But if she has relatives who take care of her, show her kindness, and look after her, then there is no objection to his divorcing her.
As for if she has no one, the best and most preferable thing for him is patience; perhaps he can do something good for her, such as treatment or otherwise. The least he can do is provide for her and treat her kindly until she is cured or Allah chooses death for her.
And regarding his statement that neither doctors nor the awliya can cure her, this requires detailed explanation: The awliya are the believers. Some people think that the awliya are people with a special status who can manipulate people, or that they have special miracles, or that they have control over the universe. This is a great error. The awliya of Allah are the people of faith, the people of taqwa (mindfulness of Allah). Every Muslim who is a believer is a wali (close friend of Allah) of Allah. Allah the Exalted said:
(62) Unquestionably, [for] the allies of Allah there will be no fear concerning them, nor will they grieve (63) Those who believed and were fearing Allahأَلا إِنَّ أَوْلِيَاءَ اللَّهِ لا خَوْفٌ عَلَيْهِمْ وَلا هُمْ يَحْزَنُونَ ۝ الَّذِينَ آمَنُوا وَكَانُوا يَتَّقُونَ
[Yunus: 62-63]. He, the Exalted, said in Surat al-Anfal:
and they were not [fit to be] its guardians? Its [true] guardians are not but the righteousوَمَا كَانُوا أَوْلِيَاءَهُ إِنْ أَوْلِيَاؤُهُ إِلَّا الْمُتَّقُونَ
[Al-Anfal: 34]. So the awliya of Allah are the people of taqwa, the people of goodness and uprightness, the righteous among the Muslims. You should know this. A wali is not a person with a special status to manipulate the universe, or to cure the sick, or to know the unseen, or the like. This is what some ignorant people think, and what some ignorant, misguided Sufis think. The awliya are the believers; they have no special status other than that of the believers. They are the believers, they are obedient to Allah and His Messenger, they are the people of taqwa and guidance. They are called the awliya of Allah, they are called believers, they are called Muslims, they are called the righteous, and they are called the good. They have nothing in their hands of knowledge of the unseen, nor of curing the sick, nor of manipulating Allah’s servants in ways beyond the servant’s capacity. Rather, they may make du'a' (supplication) and Allah may benefit through their du'a'. They may perform ruqyah (healing by Qur'anic recitation) on the sick and Allah may benefit through their ruqyah, just like other believers. They do not have a special attribute. In fact, every believer is a wali of Allah . They do not have control over the servants or the universe as some ignorant Sufis and others think. Whoever thinks or believes that some people manipulate the universe with Allah, who manages the universe, cures the sick, and knows the unseen, this is kufr (disbelief) and misguidance. It is major shirk (associating partners with Allah). We seek refuge in Allah from that. The curing of the sick is in the hand of Allah, and knowledge of the unseen is with Allah . The management of the servants is in His hand, Exalted and Majestic is He. No one manages the servants other than Him . The questioner should know this and be on clear guidance so that he does not fall into the false beliefs of the ignorant regarding what they call the awliya. We ask Allah for success and guidance for everyone. Yes.
