Question:
What is your opinion, Your Eminence, regarding those who graduate from the Institute of Administration in our country in law, and are appointed as judges in our ministries and departments, ruling by other than what Allah has revealed, and are called legal advisors? What is your opinion regarding those who sue them for this? Is their leading the people in prayer valid? And what is the solution to all of this?
Answer:
If they learn the law so that they may judge by the Shari'ah of Allah, and invalidate what in it contradicts the command of Allah, then there is no harm in that. Studying the law is to remove the evil in it and to know the evil in it. As for judging by it, that is not permissible. However, those who studied the laws to know the falsehood in them, and to free themselves from what happens with companies and non-companies, so that they know their laws and what they enforce upon them, so that the permissible and the Shari'ah ruling is executed upon them.
And if they see that a legal judge has ruled by other than what Allah has revealed, they should report it to the authorities, or to the Shari'ah courts, or to a judge among the judges, so that they may look into the matter. This is because they learned to use this to free themselves from the false laws of these companies and what they claim, so that our children and the employees among us may know these laws with insight, and so that they may free themselves from them by the ruling of Allah, and so that they may discuss them by the ruling of Allah. This is the purpose of this study: to know its falsehood and its evil, so that it may be treated.
Question: O Shaykh, they study man-made law and do not study the Shari'ah law?
Answer: The judges of the Shari'ah are graduates of the Shari'ah. This is what we know in our country.
Question: In some Muslim countries, they study man-made laws and do not know the Shari'ah laws. Is it permissible to study them?
Answer: This is a mistake. One must study this along with that, so that he may distinguish between them and know the superiority of Islam over this false law. As for him studying the falsehood and leaving the Shari'ah law, this is false and reprehensible.
