Question:
I hope you will hear this suggestion of mine, may Allah reward you with good. I clearly perceive the injustice of many employers toward the workers who work for them, both Muslim and non-Muslim. Many cases have come to your attention, so why do you not give these poor, oppressed workers their due by writing to those responsible for this matter to rescue them and give them their wages or reasonable, acceptable wages, and not to equalize wages to fit the same work regardless of the worker's nationality or identity?

The obligatory duty, my brother, is as the Prophet (peace and blessings be upon him) said:
Muslims are bound by their conditionsالمسلمون على شروطهم
So if they agree with them on conditions, it is obligatory for the worker to fulfill them, and it is obligatory for the employer to pay the wage. Muslims are bound by their agreements, not by the whims of Zayd or 'Amr. If they agree on something, it is obligatory for the worker to fear Allah and fulfill the trust, and it is obligatory for the one who hired him to fulfill his right. I have heard the hadith
Allah said, 'I will be an opponent to three types of people on the Day of Resurrection: -1. One who makes a covenant in My Name, but proves treacherous; -2. One who sells a free person and eats his price; and -3. And it is upon the state, may Allah guide it, and upon the ruler of every land to give them their due. If they do not give them their due, then it is obligatory that they be referred to the court, and this is the reality. Some people have contacted us about this many times, and we have written with them to the authorities to give them their due and compel the employer to fulfill the right he owes, or to go with them to the court so that it may look into their case. This is the only way: either he gives them their due of his own accord and fears Allah, or he is referred with them to the courts, for them and for others, so that it may look into the claim.
Not everyone who says that the employer did not give him his due is truthful. The worker may be lying, and the employer may be lying. Neither of them is protected from error. If they differ and dispute, and it is possible for a Muslim to reconcile between them, remove the dispute between them, and mediate between them, then he is rewarded
So fear Allah and amend that which is between youفَاتَّقُوا اللَّهَ وَأَصْلِحُوا ذَاتَ بَيْنِكُمْ
[Al-Anfal:1]. If it is not possible for anyone to reconcile between them, then they have no choice but to return to the courts, like others, so that it may look into the claim of this one and the claim of that one.
