Ruling on the use of stagnant water

Machine translationRead the Arabic original
Q2: The questioner, A.A. from Yemen, says: In our village, there is a mosque with a pool or basin of water for ablution. The water remains in it for five months or more, and its color and taste change, yet they continue to perform ablution from it at all times. Please inform us, may Allah reward you, about the validity of this?
A2: There is no harm in that, as long as their ablution is performed outside the pool or basin, and they do not perform ablution inside it, nor do they take a full ritual bath inside it; for there is no harm in performing ablution from it as long as there is water in it, even if it has been there for a long time, or even if it changes due to its staying there, for that does not cause harm; rather, it only causes harm if it changes due to impurity. Likewise, if they were to take a full ritual bath from major ritual impurity inside it, that would be prohibited due to the prohibition of the Prophet (peace and blessings be upon him):
forbade urinating into standing water then performing Ghusl with itنهى أن يبال في الماء الراكد ثم يغتسل منه
Sunan an-Nasa'i 399Sahih (Darussalam)
meaning: water that does not flow. As for the fact that they take a full ritual bath and perform ablution outside of it, there is no blame on them for that, and the remaining water is pure and can be used for ablution until it runs out, even if it changes due to its staying there, for that does not cause harm, if Allah wills.
