Q: One of the sisters asked me to write to you to ask about
the ruling in the following: This sister says that more than ten years before she got married, she went with her parents to Makkah al-Mukarramah for 'Umrah, and she was coming from al-Ta'if . She was on the fifth day of her menstruation, and because she was young at the time and did not know the rulings of ritual purity well, she performed the full ritual bath and did her 'Umrah. When she returned to al-Ta'if , she found that her monthly period was still upon her, and she did not inform anyone of this. After about that many years, she got married, and the same thing happened to her that had happened when she wanted to do 'Umrah. She wants a fatwa from you, and whether she owes an expiation or a sacrificial animal? May Allah reward you with good.
A : If the situation is as described, then the aforementioned 'Umrah is not valid, and she is still in the state of ihram. She must return to Makkah and perform the 'Umrah for which she entered ihram. The marriage contract that took place is not valid, so it must be renewed. If intercourse occurred, then her 'Umrah is defective, and she is obligated to continue with it and then return after completing it to the miqat from which she entered ihram, and enter ihram for a new 'Umrah to make up for the defective 'Umrah. She must slaughter a sheep in Makkah that is acceptable as an 'Id sacrifice, and distribute it to the poor of the Haram . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
