Zakah on a Debt
Machine translationRead the Arabic original
Q2: I borrowed a sum of money from a friend. After a period of time, I had this amount available, so I offered it to this friend as repayment of the loan. However, he refused to accept it, saying that he had no need for it now, and left it with me. It has now become surplus to his needs and mine. Who is responsible for paying its zakah, the original owner or I? Please advise us, may Allah reward you with good.
A2 : It is obligatory for the owner of the wealth to pay zakah on his wealth if it has reached the nisab and a lunar year has passed over it. You owe nothing in this matter, for the money, as you described, is a deposit with you, unless he has appointed you to pay its zakah on his behalf, in which case you pay it. It is also good, as mentioned in the first answer, to raise the matter with him to clear your conscience. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
