Fatwa No. ( 18290 )
Q: With the praise of Allah, the establishment of the Charitable Society for the Care of Orphans in Makkah al-Mukarramah has been completed, and Article No. (3) of the Society's basic regulations defines its objectives as follows: The Society aims to provide the services its region needs without its objective being the acquisition of material profit, and these services include the following: 1- Instilling the principles of the pure Islamic religion and sound creed in
The mind and soul of the orphan, so that he grows up with a strong creed, firm faith, and sound thinking. 2- Providing spiritual and material care for the orphan, or one in his position, from those with special circumstances, from his birth until the completion of his education or vocational training, and placing him on the path to facing his life. Examples of this care include: a- Securing the disbursement of a monthly allowance to the guardian of the orphan and one in his position, to help him face the costs of living. b- Providing assistance in facing problems that may hinder the continuation of the orphan and one in his position in studies at all levels of education. c- Providing health care for the orphan and one in his position, ensuring his safety from diseases, maintaining his health, and instilling in him strength and vitality. d- Providing social care and services for the orphan and one in his position within his family and natural environment, achieving the satisfaction of all his psychological, social, biological, and other needs. 3- Working to establish programs, projects, and shelter centers, and managing them with sound scientific management in accordance with the Society’s objectives and services, and in facing what may hinder the care of the orphan and one in his position, from those with special circumstances in their natural environment. Also, managing any programs, projects, and institutions that the Ministry of Labor and Social Affairs may entrust to the Society within the scope of the Society’s work.
And managing them with sound scientific management in accordance with the Society’s objectives and services, and in facing what may hinder the care of the orphan and one in his position, from those with special circumstances in their natural environment. Also, managing any programs, projects, and institutions that the Ministry of Labor and Social Affairs may entrust to the Society within the scope of the Society’s work. Naturally, the vast majority of these orphans whom the Society will care for, whether by sheltering them in the Society’s premises or by caring for them while they reside among their families and relatives, will be from the poor and the needy. Also, a number of them will be from the abandoned who have no provider at all, and this category has been considered in the position of an orphan. Is it permissible for the Society to spend on the livelihood matters of these orphans and those in their position, such as housing, food, drink, clothing, health care, educational and cultural care, and other such things, from the zakah funds that reach the Society? It is known that if we hypothetically assume that a portion of these orphans will be from affluent families, it will then be possible to determine their proportion with complete accuracy.
A: If the reality is as mentioned, that these orphans are from the poor and the needy, then it is permissible to distribute zakah to them. As for the affluent orphans, no
zakah is to be spent on them, but rather from their own funds. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
