Establishing a Tribal Fund
Machine translationRead the Arabic original
Fatwa No. ( 21337 )
Q: The questioner asks about the agreement among the Al-Yahmad tribe to establish a fund pursuant to a founding memorandum consisting of five clauses containing
multiple paragraphs.
A: After reviewing the attached agreement, it was found to include financial obligations that must be fulfilled by the members of the kinship group. Anyone who does not participate in this agreement is considered to have severed ties with the members of the kinship group and bears the consequences thereof himself. If this is the case, it is not permissible to agree to such matters and enforce them, because it is imposing what Allah and His Messenger did not impose. This leads to severance, hatred, and animosity, which are certain to occur, and this contradicts the objectives of the pure Shari'ah, which are to achieve affection, love, and cooperation among relatives. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
