Q: We are the tribe of Dhawi 'Aliyan from the tribes of Banu Sulaym , and we have established a fund specific to this tribe, in which both its rich and poor participate, as well as every one of them who has reached the age of maturity. This fund was established according to the following conditions: 1 - This fund is exclusively for this tribe. 2 - This money is not used for trade or investment. 3 - If any member of the tribe who is a participant in the fund passes away, his specific amount is returned to his heirs. 4 - This fund is designated for the misfortunes that befall this tribe, God forbid, such as car accidents, legal blood money, disputes, and others. 5 - The amount taken from the fund is withdrawn as a loan in times of urgency, and is distributed among the tribe later, then returned to the fund. 6 - It is prohibited to withdraw any amount from the fund for the following matters: if any individual from the tribe incurs, God forbid, problems related to prohibited and forbidden matters, such as narcotics, unlawful sexual intercourse, theft, and the like, no payment is made for him from this fund. O Shaykh, may Allah prolong your life, our question is: Is there
zakat in this fund? We ask you to inform us of the answer to this question with an official written fatwa to clarify this for the members of the tribe, and may Allah reward you with all good. And peace be upon you and the mercy of Allah and His blessings.

A: Zakat is obligatory in the aforementioned fund because it has not exited the ownership of its owner; rather, it is in the ruling of a loan. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
