The questioner : She says that she is married and has four children, and after her husband agreed to her travel and all the procedures were completed, he refused again with a categorical refusal and swore by divorce that if she traveled, she would become forbidden to him. However, she insisted on traveling despite the number of divorces he swore to in front of her. Finally, he said, "I forbid you from traveling, so that you will be divorced," but she traveled. Ten months have now passed since this matter, and she is now preparing to return to her husband and children. Does she have the right to return to him after that, or not?

The Shaykh : First, it is forbidden for this woman to travel without her husband's permission. As long as her husband has not given permission, it is forbidden for her to travel, even if he had given permission and she had prepared for departure and gotten ready to travel, and then he withdrew his permission. The right is his in that matter, so it is not permissible for her to travel except with his consent. As for what happened with the husband, we say, as we said a moment ago, if he intended that if she did this thing, she would be divorced, and he was averse to her and to remaining with her, then she is divorced by this action. But if he intended by that to warn her and make her fear, then she is not divorced by it, and he owes an expiation for an oath, since she contradicted him in this matter.
