The fourth question of Fatwa No. ( 21488 )
Q4: My father passed away, leaving behind a waqf for his mother consisting of goats, numbered (15 or 20), knowing that we do not know their exact number, nor can we distinguish them from the other goats, knowing that my father used to give charity from them every year. What is the ruling on this?
A4: You must identify this waqf, and you should act based on certainty by taking out from the goats what clears your father’s liability, and you should develop this identified portion of the goats and give charity from it on behalf of your grandmother according to what she specified in her bequest. If she did not leave a bequest, then according to your father’s practice. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
