Fatwa number ( 20895 )
Q: A few weeks agomy grandfather, my father's father, passed away. We are the children of his son who died eight years ago; there are five of us, three sons and two daughters. He also had one daughter, my father's sister, who has children as well. He had brothers and sisters from his father's side, all of whom have children, and each of them lives in their own separate house. Please note that we have a brother from our father's side, born to a second wife who was divorced. As for my grandfather's assets, he left only the following: First, a simple house where we, his grandchildren, live with our mother. No installment of the bank loan for building this house has been paid. Second, 140 head of sheep, which is the remainder of approximately 576 head that were sold a few weeks before his death.
A: After the death of your grandfather, the sheep and money he left behind become the inheritance of those mentioned in the list of heirs, namely his daughter and the children of his son. This is after his debts are paid and his lawful will is executed. His daughter receives half, and the children of his son receive the remainder, with the male receiving the share of two females. The sheep are sold, their value is totaled with the existing money, and the whole is divided among the aforementioned heirs. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
