Q: I am a shepherd, and stray sheep come to me. A small ewe came to me, and she has been with me for about three years. She gave birth to a ewe, and that ewe gave birth to a ewe. She also produced a ram and a ewe. The ewe was eaten by a wolf, and I sold the ram. Nevertheless, I have advertised for them, but no one has come to claim them. Also, there was a ram that stayed with me for (4) months, and no one came for it, so I ate it. There is also another ewe with me, which is about a year old, and she has given birth to one ewe, and no one has come to claim her until now. I ask for your guidance.
A: First: We advise you not to take possession of stray sheep unless you know them for a year. This is done by calling out, or appointing someone to call out, in the places where the owner is likely to be, for a period of one year, at appropriate times when the owners of lost sheep are expected to be present, once or twice every month until the year is complete. Second: If someone comes forward during the year and describes the characteristics of the lost sheep, give them to him, along with their offspring. Third: If the year is completed and no one comes forward claiming ownership of these sheep,
then they become yours, along with their offspring. Fourth: Since you took these sheep and bred them without performing these Sharia procedures, you must estimate their value and give it in charity on behalf of the owner. If the owner comes later, he has the choice between accepting the charity, in which case the reward is his, or taking the value of the sheep, in which case the reward of the charity is yours. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
