Wealth that reached its owner through unlawful and forbidden means: is zakah due on it?
Machine translationRead the Arabic original
The second question of Fatwa No. (18490)
Q2: Is zakah due on wealth that reached its owner through unlawful and forbidden means, or not? And what is the ruling on charity given from it and marriage?
A2: Wealth that reaches a Muslim through a forbidden path, and he knows it is forbidden at the time it reaches him, he must repent to Allah from it and dispose of it by placing it in a general public project, other than building mosques, or by giving it to the poor and needy. It is not permissible for him to possess it while knowing that it is forbidden. However, if it reached him through usurpation, plunder, theft, or the like, he is obligated to return it to its owners by any means, if he knows them, or to their heirs if they are deceased. If he does not know them, he gives it in charity with the intention that it be on their behalf.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
