Q: There is an old mosque in our village, and this mosque was built next to an old cemetery that is older than the mosque. This cemetery is located to the east of the mosque. Then, after the mosque was built, new graves were constructed in the direction of the mosque’s qiblah, with approximately four meters between them and the mosque. There is no wall separating the mosque from the cemetery, so the mosque is surrounded by graves on the east side and also on the qiblah side . What is the ruling on praying in this mosque, and what is the ruling on the prayers that have been performed in it for approximately twenty years? Should this mosque be demolished and another mosque built in a different location? I ask your Eminence to kindly answer these questions, as the people of the village are in a difficult situation regarding their affairs.
A: If the situation is as described, that the graves are far from the mosque, then this does not affect the permissibility of building the mosque or the validity of the prayer in it. However, the cemetery should be walled off in order to preserve it, and a strip of land should be left between its wall and the wall of the mosque.
