And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the General Manager of the Tabuk Regional Branch of the Ministry of Islamic Affairs, numbered 956/27/1 and dated 16/4/1432 AH, containing the question of Ahmad ibn Ali Saleh, which was referred to the Committee by the General Secretariat of the Council of Senior Scholars, numbered (596) and dated 25/4/1432 AH. He asked a question, the text of which is as follows: (In Yemen there are (military) hospitals that distribute medication for free to soldiers, where soldiers can obtain that medication in several ways: 1- The soldier is actually ill, so he is dispensed treatment for that illness. 2- The soldier fabricates an illness (which he does not suffer from) in order to be able to obtain the medication.
3- The soldier obtains the medication he wants by a method other than the two previous methods (such as agreeing with the official to dispense the medication by giving him that medication), or the official himself may have taken the medication without a prescription from a doctor, in short, by an unlawful method. And my question is: Is it permissible for me (as the owner of an external pharmacy) to purchase that medication from the soldiers if they wish to sell it to me, and what is the ruling in each case?
After the Committee studied the inquiry, it answered: If you know or it is most likely in your mind that the medication offered for sale was obtained by an unlawful method, then it is not permissible for you to purchase it, because your purchase of it constitutes cooperation in sin and aggression, and Allah the Exalted has forbidden that in His saying:[Al-Ma'idah 5:2] .
