Q8: What are the conditions of mixed livestock owned by more than one person liable for zakah ?
A8: The conditions of the mixing that makes the mixed wealth of several people like one single wealth are: 1- That the two parties mixing their wealth be among those liable for zakah; if one of them is not liable for zakah, such as a disbeliever, then the mixing has no effect. 2- That the mixed livestock reach the nisab; if they are below it, there is no zakah
on them. 3- That the mixing continue for a full lunar year; by scholarly consensus, the mixing is not considered for less than a year. 4- That the mixed livestock share the same resting place, which is the place of lodging and shelter, and the same assembly place, which is the place where they gather to go to the pasture, and the same drinking place, and the same milking place, which is the place of milking, and the same breeding male, such that one male services them and each person’s livestock does not have a separate male, and the same pasture, which is the place and time of grazing. The evidence for the effect of mixing under these conditions is the saying of the Prophet (peace and blessings be upon him):
Do not combine separate flocks or separate combined flocks for fear of Sadaqah, Each partner (who has a share in a combined flock) shold pay Sadaqah in proportion to his shares.لا يجمع بين متفرق، ولا يفرق بين مجتمع خشية الصدقة، وما كان من خليطين فإنهما يتراجعان بينهما بالسوية
