Q1: I have heard some shaykhs issue a ruling that a rak'ah in congregational prayer is not caught unless one recites al-Fatihah, and I have heard shaykhs who rule that it is caught by the ruku'. What is the stronger opinion, with the evidence and the opinions of the scholars? May Allah reward you with good.
A1: The rak'ah is caught by catching the ruku'; based on the hadith of Abu Bakrah (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) said to him when he caught the ruku' before entering the row:
May Allah increase your eagerness! But do not do it again.زادك الله حرصًا ولا تعد
Sunan Abi Dawud 683Sahih (Al-Albani)
, and the Prophet (peace and blessings be upon him) did not order him to make up the rak'ah in which he did not recite al-Fatihah; and based on the generality of his (peace and blessings be upon him) saying:
Whoever catches a raka of the prayer has caught the prayer.من أدرك ركعة من الصلاة فقد أدرك الصلاة

, which Muslim recorded in his (Sahih), and whoever catches the ruku' has caught the rak'ah. As for if the ma'mum is able to recite al-Fatihah, it is obligatory for him to recite it; based on the generality of his (peace and blessings be upon him) saying:
There is no Salat for the one who does not recite Fatihatil-Kitab.لا صلاة لمن لم يقرأ بفاتحة الكتاب

Perhaps you recite behind your imam? We replied: Yes, it is so, Messenger of Allah. He said: Do not do so except when it is Fatihat al-Kitab, for he who does not recite it is not credited with having prayed.لعلكم تقرءون خلف إمامكم؟ قالوا: نعم، قال: لا تفعلوا إلا بفاتحة الكتاب، فإنه لا صلاة لمن لم يقرأ بها
Sunan Abi Dawud 823Da'if (Al-Albani)
, which the Imam Ahmad and others recorded with a sound chain, and his (peace and blessings be upon him) intended meaning by that is: the loud prayers. As for the silent prayers, it is prescribed for him to recite in them, along with al-Fatihah, whatever is easy of the Qur'an in the first and second rak'ah.
