The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the residents of the village of Al-Qwai' in Hawtat Bani Tamim , requesting that the residents' hardship be alleviated by addressing the situation of the southwestern corner of the Al-Qwai' Cemetery ; as it is crowded against the intersection and obstructs the view for drivers, which has caused many fatal accidents to lives and property. The request was referred to the Honorable Head of the General Court in the province of Hawtat Bani Tamim for a detailed report on the facts of the matter. A response was then received via letter number (2359) dated 10/11/1431 AH, accompanied by the decision of the Review Board at the Court of the province of Hawtat Bani Tamim , addressed to its head with number (159) dated 9/11/1431 AH, stating that there are no graves in the corner of the aforementioned cemetery that is being requested to be cut off from the cemetery land, as it is located 350 meters away from the graves. The Permanent Committee for Scholarly Research and Ifta has also reviewed the sketch map prepared by the Municipality of Hawtat Bani Tamim , attached to their letter number (1759) dated 27/8/1431 AH, which shows that the part proposed to be cut off for the benefit of the road from the Al-Qwai' Cemetery
is in the shape of a triangle, located in the southwestern corner of the cemetery on the Al-Halwa road, at the junction with the road exiting the town of Al-Qwai' . Its boundaries and lengths are as stated in the aforementioned sketch map as follows: North: the remainder of the cemetery, with a length of (fifty meters and twenty centimeters); this side slopes until it meets the southern side adjacent to the main road running from Al-Hawta to Al-Halwa, forming the apex of the triangle. South: the main road running from Al-Hawta to Al-Halwa, with a length of (forty-nine meters), where it meets the northern side at the apex of the triangle on the eastern side. West: the main road of Al-Qwai', with a length of (twenty meters and twenty centimeters). The total area of this part is (489.60 m²), four hundred eighty-nine meters and sixty centimeters. The Honorable Head of the General Court in the province of Hawtat Bani Tamim supported the cutting off of this part from the cemetery, in his letter addressed to the Head of the Al-Halwa Municipality, number (1514) dated 26/6/1429 AH, which stated: (For your information, I inspected the aforementioned cemetery and found that the walls of its southern and western corners obstruct the view for those coming from Al-Qwai' and heading to the main road, as well as obstructing the view for those on the main road of what is on the Al-Qwai' road, and that it has caused many
traffic accidents. And since this corner is far from the graves, there is nothing to prevent the reconstruction of this corner after leaving a strip unbuilt; so that it remains a sanctuary for the cemetery, and the construction after it is such that users of the road can see each other). The Permanent Committee also reviewed a copy of a letter from the former Grand Mufti - may Allah have mercy on him - addressed to the Honorable Judge of Al-Halwa , number (10962/2) dated 15/6/1406 AH, which included not taking anything from the Al-Qwai' cemetery for residential use .
Therefore, the Permanent Committee for Scholarly Research and Ifta has issued a ruling to cut off the part proposed above, which is confined to the southwestern corner of the Al-Qwai' Cemetery in the shape of a triangle, with its lengths and area specified in the aforementioned sketch map, taking into account the public interest and the preservation of the lives of those traveling on these two roads. Accordingly, the wall adjacent to this part is to be removed and reconstructed after this excised part is removed from the cemetery.
