The Al-Qasr Cemetery in Al-Qasabah Intersects Part of the Road Route

Praise be to Allah alone, and may peace and blessings be upon the one after whom there is no prophet. After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from His Excellency, the Head of the Al-Ayṣ General Court, reference number (1155), dated 14/9/1431 AH, and referred to the Committee by the General Secretariat of the Council of Senior Scholars, reference number (1276), dated 10/10/1431 AH. His Excellency requested the Committee to review the letter from the Acting Head of the Al-Ayṣ Municipality, reference number (28346), dated 26/8/1431 AH, attached hereto, which stated the Municipality's intention to implement the dualization of the Al-Qasabah ( Al-Ayṣ) road, and that the Al-Qasr Cemetery in Al-Qasabah intersects part of the route of the aforementioned road. His Excellency expressed the desire to expropriate the intersecting part of the cemetery for the benefit of the road. The request was referred to His Excellency, the Head of the Al-Ayṣ General Court, by letter number (1296/2), dated 26/10/1431 AH, to form a committee from the Court, the Emirate, the Commission for Promoting Virtue and Prohibiting Vice, and the Municipality, to inspect the aforementioned cemetery, determine whether the route of the aforementioned road can be diverted from the cemetery to the other side, and if that is not possible, whether there is a necessity to cut out the part that intersects the road route, along with
specifying the area of the cemetery, drawing a sketch map of the site and its surroundings, clarifying the part proposed for cutting, and preparing a detailed report on it. Then, the response came by letter number (1488), dated 18/11/1431 AH, accompanied by a report from the committee that inspected the cemetery site and the proposed road implementation. The report stated: Minutes of the committee inspection dated 16/7/1431 AH. Based on the letter from His Excellency the Head of the Al-Ayṣ Center, reference number (1/302/1784), dated 14/7/1431 AH, which was based on the letter from His Excellency the Head of the Al-Ayṣ Municipality, reference number (23477), dated 11/7/1431 AH, regarding the Municipality's desire to implement the dualization of the Al-Ayṣ Al-Qasabah road, and the request to form a committee from the Emirate, the Court, the Police, the Municipality, the Commission for Promoting Virtue and Prohibiting Vice, the Endowments, and the Mosques. On Monday, corresponding to 16/7/1431 AH, the members of the aforementioned committee inspected the Al-Qasr Cemetery in Al-Qasabah, where part of it intersects the road route, and the Municipality's need to cut out that part, according to the markers placed by the Municipality. Upon the aforementioned committee's exit to the cemetery, it became clear to the committee that there are no graves in the part designated by the Municipality, and it is necessary for people of expertise to inspect the cemetery
to fully know the area. The people of expertise inspected the site with a representative of the Municipality and confirmed that there are no graves in the aforementioned part, as stated by the committee members. It will be submitted to His Excellency the Judge of the Al-Ayṣ Court to express his views on the matter. Accordingly, the signatures were placed.

After the Committee's study of the inquiry, it issued a ruling that there is no objection to expropriating the part proposed for cutting from the aforementioned cemetery, as indicated in the attached sketch map, which is estimated at: (eight hundred and sixty-eight meters and sixty-six square centimeters 868.66); this is for the public benefit, and because it is not possible to modify the road route away from the cemetery, for the reasons mentioned in the attached letter from the Head of the Municipality. The expropriated part of the cemetery will be compensated according to the established practice and placed in a similar cemetery.
