Q: A child was born to me in the seventh month and was dead, and he remained
15 days in his mother's womb while dead. After the birth, I took him to the cemetery, and the one who prepares the body for burial told me: "This one is not washed, because he was all blood and his flesh was dissolved; if you put water on him, it would crumble." He shrouded him without washing him. Some of those present with me told me: "This one is not prayed over." I buried him without prayer and without washing. Is my action correct? And if the prayer is obligatory upon him, is it permissible now, since three months have passed?

A : If a person dies and is buried and no one has prayed over him, it is obligatory to pray over him at his grave; because the prayer over the dead is a collective obligation (fard kifayah), and it was not performed. Its performance is achieved even by the prayer of one person, as the scholars have stated regarding the dropping of a collective obligation. Based on this, you should pray over your son's grave alone or with a group. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
