Q 3: What is the ruling on a woman who dies while married to a non-Muslim, regarding washing, shrouding, prayer, and burial?
A 3 : First: It is not permissible for a Muslim woman to marry a disbeliever; because Allah the Exalted said:
And do not marry polytheistic men [to your women] until they believeوَلاَ تُنْكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا
[Al-Baqarah 2:221]
, and He the Exalted said:
And if you know them to be believers, then do not return them to the disbelievers; they are not lawful [wives] for them, nor are they lawful [husbands] for themفَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَاتٍ فَلا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ لاَ هُنَّ حِلٌّ لَهُمْ وَلاَ هُمْ يَحِلُّونَ لَهُنَّ
[Al-Mumtahanah 60:10]
, and if a woman embraces Islam while she is under the marriage of a disbeliever, it is obligatory for her to separate from him. Second: If a Muslim woman dies while married to a disbeliever, it is obligatory to wash her, shroud her, pray for her, and bury her in the graves of Muslims.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
