Q: Is it permissible for a man to wash a female relative other than his wife?
A: It is not permissible for a man to wash a woman other than his wife, whether she is a mahram or a non-mahram, except for a small girl who died before the age of seven, for he may wash her. Accordingly, if a woman dies and only men are present, among whom there is neither her husband nor a woman, they should perform tayammum in place of both wudu and ghusl, giving precedence to the preservation of her 'awrah. This is because it is the norm for one who handles the washing of the deceased, even if only by pouring water over her, that his gaze falls upon some of her 'awrah, and that he touches her and turns her over in order to be able to spread the water over her body. Thus, tayammum for a deceased woman with only men present is more protective of her 'awrah and more cautious in safeguarding her modesty. Her slave woman, whom he owns by lawful ownership, is included with his wife in the permissibility of washing her if she dies while being permissible for him; that is, if she is not in the protection of a husband at the time of her death or in her 'iddah from him. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
