Q: One day, an accident occurred, and the result was the death of five people: four women and one man. The driver’s share of the fault was
50%, and 30 years have passed since the accident. He does not have the ability to free a slave, nor the ability to fast if the expiation for each deceased person is two consecutive months, and the person who caused the accident is 60 years old, knowing that it has now been 30 years since the accident. Is it permissible for one of his relatives to fast on his behalf, or to feed on behalf of each of the deceased? And does he feed sixty poor people? I ask for detail and clarification, and may Allah reward you with good, and may Allah send prayers and peace upon our Prophet Muhammad and his entire family.

A: If the situation is as you described, namely your inability to free a slave and your inability to fast two consecutive months for each person whose death you caused, then there is no sin or blame on you in that, if Allah wills. The expiation remains a debt on you until you are able to free a slave or fast. Feeding does not suffice in place of fasting in this case, and the fasting of another person does not suffice for you as long as you are alive.
